Legal Question in Elder Law in Washington

joint power of attorney

i need a form in washington state that would allow two people to serve as power of attorney for an elderly relative. the form should allow for the people to act independently on financial matters up to a certain amount - then require joint action. it also should revoke any and all prior poa forms.

Re: joint power of attorney

Then you need an attorney to draft it for you. The attorney's client is the principal - the elderly relative you describe, not you or the joint attorney-in-fact.

You don't say where you are. If you email me and say what county you are in I can give you a referral.

You can get forms at the office supply store, but the form cannot tell you whether it will be effective or not. Only counsel can. And if you have an ineffective form you have no recourse and no way to fix the problem when you need it other than a costly, invasive guardianship proceeding.

Durable Powers of Attorney take less than an hour to prepare. I do them for under $200. Sometimes significantly less.

But given the facts you are describing, this isn't something you can buy off a shelf and have the principal sign.

I know this is not what you wanted to hear but I hope it helps. Elizabeth Powell

I agree with Ms. Powell. While not terribly complicated for an attorney to prepare, you will not find such a document in any forms library or off the shelf product that I've ever seen or reviewed.
