child visitation

My husband and I have a temporary order where he gets our baby certain days. If he is out of town and I am the custodial parent and am available he says he has the right to have anyone to pick her up and have her for those times even though he is not there or in town. Is this true? Also he is the petitioner and filed the temporary orders can I file my own?

Because you have not resolved this issue in the temporary parenting plan, either of you could refuse to transfer the child to somebody other than the other parent, but I usually advocate caution in how far a person pushes this issue. Courts don't enjoy deciding who besides the parents can or can't pick up the child and would much prefer that the parents work out an agreement on that.
