No one. The person who files the suit is the Petitioner and the person who receives the suit is the respondent.

A divorce is not going to be dismissed in favor of a respondent, the way a lawsuit can be resolved in favor of the defendant.

It takes two people to get married, but only one person to decide to end the marriage.
