threats of a lawsuit

I am being threatened with a law suit. The notice of intent to sue came on official company stationary. I thought I was being sued by the company when it turns out its by an individual. I would like to counter claim and include the company listed on the stationary. Is this possible?

Do you have a collection agency or an individual after you?

In Washington, unless you are a municipality, there is no notice requirement before commencing suit.

Now, if a person shows up with a summons and complaint, that's a lawsuit.

There is no claim - yet. Thus you have no basis for a counterclaim, so slow down here.

However, what you are describing may be the basis for a claim (by you) of a frivolous lawsuit, for which you can counterclaim for your fees and costs.

But without knowing more, I can't offer any more helpful advice.
