Legal Question in Employment Law in Washington

commissions eaned and not paid

I have commissions that I have earned. The products have been delievered and the client has paid for them.

I have moved on to another company and my ex boss is refusing to pay my earned commissions.

I have been an independant contractor for over 25 years and have never signed a non compete sales aggrement contract of any kind.

I was not layed off, I simple went to another company where they can help my clients with better service and I will be able to aquire larger companies because of my new companies capacities.

What can I do to get my earned commissions?

thanks

Re: commissions eaned and not paid

A clearly worded letter from an attorney might do the trick. If your boss is withholding your commissions, not because he or she legitimately believes they are not due, but just because he or she does not care to pay you, you may be entitled to additional damages over and above the commissions owed you.

If that does not prove to be sufficient, you may want to bring a suit against your former employer. Depending on details, you might also be able to get your reasonable attorney's fees paid, if you prevail.
