Yes I have some people who moved into my rental without permission.The people broke into the place and started living in the house.I told them that the place was not ready to rent until the electricity was fixed.some lights didnt work.They did give me a down payment of 300.00 and after I told them when I could have the power fixed They moved in early anyway.I found out they were living in my rental when i went over there to fix some things and couldnt get in because they put on a new lock.I recently gave them an eviction notice of 20 days.They want to pay rent but I want them out.How do i get them out with out the hastle of going to court.They are distroying the place.There is no legal written contract signed by tenant.Its all verbal.Help me legally get them out.

You'll have to go to court. Give them a Termination of Tenancy Notice of at least 30 days but with the end date on the first of the month (or whenever you collect rent). The tenancy is on a month-to-month term if oral. If they have not left at the end of the 30 day period, you'll have to file an Unlawful Detainer action in Superior Court. It usually takes about 30 days once the action is filed to have them evicted by the Sheriff. I strongly suggest you spend the $500-1,000 to hire an attorney to evict them.
