Property

I've been told that my husband and I should have a property agreement in the event of one of our deaths. That way the property will go directly to the surviving spouse and can not be tied up in probate in the event that someone in the family contests the will. What can you tell me about this?

If the property is now owned in a joint tenancy versus a tenancy in common, then you have nothing to worry about. Upon the death of one of you, the other owns the whole thing outright.

That said, if there is a will that does anything to contradict what I just said, then you may want to have the will reviewed with an attorney to determine if changes need to be made to effectuate your wishes upon the death of either of you.
