Legal Question in Real Estate Law in Washington

tree removal liability

I am having a house built and have not yet taken possesion, there is a tree in my yard that I wish to have removed because it is tall and close to the house. What is the builders liability (resposibility) to remove the tree once I have expressed concern?

Re: tree removal liability

Unless it is in the builder's contract, or is required to adequately and safely build the home to come within building code specs, the builder has no responsibility to remove the tree.

Whether you voice concern or not, if the tree is too close to the home, and a reasonable builder would or should have known this, then it is arguably the builder's responsibility to remove the tree. Please note, the facts of each care are very important, and before being able to get more specific than that, we'd have to talk. I suggest you try and work it out with the builder before deciding to get lawyers involved. If you reach an impasse or things get heated, then call a lawyer.
