How to file when not married

We have debt in both our names, mainly house and car not yet paid for. Unsecured debt, some are not contacting amount was under 20,000 and now only a few debtors are actually contacting we are on the way ''back'' but by no means have the money to pay so bankruptcy prob is the way however how best to proceed

Just because a creditor does not contact you for a while does not mean that the creditor will go away. You may see a collection agency pick it up and start to receive nasty calls. You should consult a lawyer or at least Consumer Credit to have a professional evaluate the whole situation and advise of your options.
