Legal Question in Credit and Debt Law in West Virginia

mentally inconpetent

My wife has gotten several credit cards and ran up the balances. I had no idea of this until they started calling about payments. She has no income, she is legally, mentally incompetent. Am I legally bound to pay these bills? They have only her name on them, she has no idea of what she used them for, there's nothing to show for this very large amount of money (14,000.). I am not financially able to pay these. What can I do? Please answer soon, destroyed & destitute. Thanks.

Re: mentally inconpetent

It is a basic rule of law that no person is liable for the debt of another unless he or she has agreed in writing. There are exceptions such as reasonable medical and hospital expenses and taxes due upon a joint return. Credit card debt does not fall into any exception I know of. I would be interested in looking at the original application for credit to confirm who applied and that there are no forgeries.
