water problems with a new residence construction

i have bought a newly built residence and am having some water problems of water coming in through the foundation walls an water coming through a retaing wall on the rear of my property. I need to know what the laws are that apply to these areas and what recourse I havel. Any help you can can provide is greatly appericated. Thanks

Dear Frustrated New Homeowner: I'm not admitted to practice law in WV, but I know a legal problem when I see it.

You are, no doubt, entitled to relief and compensation for unreasonable damages to your new home. No basement, built properly and waterproofed properly, with proper drainnage systems, should leak as you've described. No retaining wall, designed and constructed properly, should leak either.

I'd recommend: 1. You doument all of this with photos, videos, etc., and

2. Contact an experienced real estate Attorney ASAP..
