small claims court
can you file a lawsuit in small claims court if the person you are suiing lives in another state than you? and how does this work?

If you want to sue someone, you need to file suit either where the wrongful conduct occurred or (preferably) where the defendant lives. It can be a defense that the suit is filed in the wrong place - its called forum non conveniens.
All states have some version of small claims court, and each state has their own rules about how you use those courts.
Chances are there is a "how - to" page on line, as well.
