Legal Question in Family Law in Wisconsin

Debt while legally separated

My cousin and his wife have been separated for 3 months. She has been using the credit cards. Most of the cards are in her name but as I understand, in Wisconsin, couples split the debt 50/50. Is my cousin responsible for all of her charges on those credit cards? I read on the internet that you can write a statement to the credit card company that states that you are separated and not responsible to any charges made after that date. Is that true & does that hold any value to do that? Thank you.

Re: Debt while legally separated

If they divorce in the near future, a court will likely deem that debt to be her own, separate debt (not marital debt for which he would also be responsible in part). However, the credit-card companies would of course seek to hold the party liable in whose name the credit cards were applied for and issued. This happens even when a court makes only one party liable for the debts in a divorce, so enforcing it is sometimes problematic.
