Legal Question in Family Law in Wisconsin

out-of-pocket expenses & Child Support costs

husband ordered to pay 1/2 out of pocket medical expenses.

His ex bills him for numerous co-payments arriving at hundreds of dollars a year, with no explanation of procedure. divorce decree state parties will agree on insurance plan that's acceptable to both, this has never happened. Husband has carried insurance for the one dependent in the past but he lives in CO and ex lives in WI. They have NO contact at all due to violence on her part. Courts have not been easy on him to say the least. Would like to talk to a lawyer - does he have to find one in Wisconsin and work with him from CO?

Re: out-of-pocket expenses & Child Support costs

Thank you for contacting us with your legal questions. My name is Hollie Hinton and I am an attorney here at The Harris Law Firm, P.C.

Your husband should talk to an attorney in the state which made the orders regarding child support. The court in that state retains jurisdiction over the matter, unless none of the parties currently reside in that state.

The answer to the rest of your questions should be found in the separation agreement the parties signed or in the permanent orders issued. For instance, look for a provision in the agreement/orders that states that "the party incurring the uninsured medical costs must provide a statement to the other party in a certain amount of time." However, without knowing exactly what the agreement/orders state, it is difficult to determine what is expected of the parties.

I really hope that this is helpful. Please feel free to contact our firm to discuss this situation in greater detail. We offer a 45-minute consult for $150.

Thank you again for your questions.
