Legal Question in Family Law in Wisconsin

remarriage in jamaica

Do the same waiting period requirements apply in Jamaica as they do in WI? WI says 6 months ... If not, would the marriage be recognized in WI before the 6-month time frame?

Re: remarriage in jamaica

Every state and country can set it's own waiting periods for remarriage following a divorce.

Jamaica will do whatever Jamaican law allows.

However, if you were divorced in Wisconsin, Wisconsin will not recognize a Jamaican marriage as being valid if you were married before the six month waiting period expired.

Other states may also not recognize the Jamaican marriage because the divorce was granted in Wisconsin. This is called "comity."
