Legal Question in Civil Rights Law in India

Hi,

I own a ground floor flat in an apartment which has 20 flats. Now there is a proposal to add a lift. As a resident of ground floor do i have to bear the cost for new lift and also for lift maintenance.

Dear Sir / Madam,

Lift is a common amenity for the convenience of all the residents in the apartment (building). Since there are 20 members in the apartment and if the builder has not yet conveyed the land to the Society, the lift should be provided by the builder who constructed the building, and all the installation costs should be borne by the builder and lift maintenance costs are also to be borne by the builder till the conveyance of the land and building is done to the Society. If the builder has already conveyed the property (land and building) to the Society and the construction of the lift is an aftermath, all the members in the Society are collectively responsible to manage all the financial and administrative affairs of the building and the surrounding upkeep of the plot.

As to the question whether you have to bear the cost of all common amenities including the new lift and lift maintenance, certainly, because even though you are located on the ground floor, whenever you or any of your family members (children and elderly residents in your house) are going to visit residents on the higher second, third, fourth or fifth floors in the building, they are going to use the installed lift.
