Can a person file a writ petition under Art. 227 of Constitution in High Court on a matter dismissed by Munsiff court 3 yrs back, without any limitation for such delay. The dismissed matter was a petition for setting aside ex-party decree pronounced 10 yrs back and delay condolation petition . Dismissal was for non- compliance of conditonal order for payment of cost for adjourment.

it would depend upon the facts of the case and explanation of the delay/latches and also the explanation for non compliance of the order for payment.
