I have been living apart from my wife ( marriage act) for 5 years. She took my son away and I haven't seen him since then. How do I get access to my son.

Under the Child Rights Law the best interest of a child is the major consideration a court of law considers in granting custody of a child in marriage. Generally, Children of tender years are given to their mother for obvious reasons but there are some exceptions to this general rule.

As it relates to custody of a child, a court will generally not grant full custody to only one parent except in certain cases. What is obtainable in most cases is shared custody.

Therefore if you want custody, you can engage the services of a lawyer to file the requisite papers in court for custody.

The advantage of going through the court process is that a breach of the terms of custody ordered by the court will be seen as contemptuous and enforceable.
