sir,my ex-husband cheated me by writing fake amount on nikah-nama. i did not get anything during marriage n post marriage as he was a fraud n made one excuse or the other. it was my fault to believe him, as a result of which i am suffering. i have waived off my mehr amount to get khula. I stay in pune n he in mumbai,so i wanted to get khula as he never took me with him.His purpose was not to give me divorce and we stay separately. i think he is already married. That is why i wanted to ask you that khula is sufficient or divorce from court also mandatory?my son has not seen his father n now as a single parent i want to raise him. Can i also claim my maintenance from court?

You can seek maintenance under sec 125 of Crpc.section 125 is secular in nature Due to the secular nature of this act this does not affect the various personal laws and also the personal laws do not affect this section. If any Muslim women seek compensation under the section 125 and she will be awarded maintenance by the respected court only if she is not remarried.
