Legal Question in Landlord & Tenant Law in India

Our landlord sued to vacate our shop room for his own business need . lost the case by default , that is did not appear few times and after apeal hounable court dismissed the case . he has agian sued for repossion of the said shop telling last time there was a mistake in his suit and as advised by his lawyer he dropped the case because it will be meaningless to pursue it any further . is he allowed to sue us twice to make us vacate after he lsot the last case by default . last time he did not send notice to me and my sister but send it only to my mother . this time also he send a notice to my mother only telling that after 5 years children has no further rights on commercial property . is it a bad notice by non-joinder and also because he dropped the last case and lost it by default and sued us again for repossesion of the same premises .
