Legal Question in Real Estate Law in India

Hi,

We have one land of my mother's name which is occupied by my aunt from last 25 years and they are not leaving the land and place, even we have given a offer that purchase from us at reasonable rate,but they are not willing to purchase the same.

As my mother & father has expired few years back and I have one elder brother.

Now please advice me ,as I want that My brother & my aunty can't sell the land without my permission.

They (Aunt & brother) need to intimate me whenever they will sell or any legal transaction for that land.

For this what I have to do please suggest me.

Dear Sir / Madam,

Since the title of the land is in your deceased parents name in the record of the Tehsildar / District Registrar, you should first initiate action and complete the prevailing transfer of title procedure, to get the title of the land transferred from your deceased mother's name, to you and / or your brother's name. If necessary, obtaining a Succession Certificate from the Court to establish your claim on the land, is also recommended.
