Legal Question in Bankruptcy in Alabama

A charge off just reported my payment as delinquent and it was 7 yrs ago

My bankruptsy was 7 yrs ago. My mortgage company which was charged off... just reported my payment as being late last month. This is seriously affecting my credit. What do I do?

You will need to dispute this in writing with the 3 credit reporting agencies (Equifax, Experian & TransUnion). It is very important to send the dispute letters via certified mail. You should receive a response back from the 3 credit reporting agencies within 30 days.

IF you discharged the debt to the mortgage company (which means you gave up your home and moved out) AND RECEIVED A DISCHARGE IN BANKRUPTCY, then IMMEDIATELY find your OLD BANKRUPTCY ATTORNEY.

Ask your attorney to (1)write a letter to the mortgage company telling them that they have violated the DISCHARGE ORDER in your bankruptcy case. IF the mortgage company does not remove the negative remaks, (2) file suit against them in BANKRUPTCY COURT.
