Legal Question in Criminal Law in Alabama

Finding Pro Bono Criminal Attorney

My friend's son is 22 and was arrested for snatching a purse. He was sentenced to 20 years. While incarcerated he was charged with attacking a guard and now they are trying to give him life in prison. The family is poor and cannot afford to hire an attorney on their own. Are there any discounted or pro bono programs for people in AL facing criminal prosecution? I've found several sites for civil but none for criminal.

If they cannot afford to hire an attorney for him, he can apply for an attorney to be appointed to represent him through the court. He will need to file a document called an Affidavit of Substantial Hardship. A judge will review that form, and assuming that he qualifies then the judge will appoint an attorney to represent him.

The Alabama State Bar also operates a pro bono project called the Volunteer Lawyers Program. However, I believe it only offers services in civil cases because defendants in criminal cases can obtain an attorney through the court appointed system.

If the family decides they want to hire an attorney rather than use one that the court appoints, I'll be glad to discuss the situation with them. If they want to use a court appointed attorney, then please just tell them to get their son to file an Affidavit of Substantial Hardship with the court. They can get one at the courthouse, or they can obtain one online at this link: http://eforms.alacourt.gov/

Good luck to you. Please let us know if we can be of assistance.

all criminal defendants who can not afford an attorney are court appointed an attorney by the court in the jurisdiction where the case occurs.
