Legal Question in Family Law in Alabama

Grandparents and violation of order

I reside in Michigan but have an Alabama court order for my ex mother in law to have a substantial amount of visitation with my daughter. The judge ordered that we share 1/2 of the costs. The judge ordered that she give me 45 days notice when exercising visitation. The judge also order that the father have no visitation then came back and said since the grandmother's home is also his home he can visit only under her close supervision.

She has never given me more than 3 weeks notice and purchases the highest fares possible. She has allowed my daughter to go visit the father, who has now moved in with his live in stripper girlfriend, for the entire time she is there. The grandmother has obviously broken the court order. I have refused to allow my daughter to go for the spring break visit a) because I was given a little more than 2 weeks notice, and b) the father is the one visiting, not the grandmother.

I know she will take to me court, so am I doing the right thing by not sending her because she isn't giving me sufficient notice and because she is allowing my daughter to go stay 50 miles away with her father alone without her supervision?

Re: Grandparents and violation of order

You are probably within your rights to withhold visitation under the situation you describe, but depending on the judge, you might want to file a petition (probably prepared by an attorney) to curtail visitation or enforce the order. An attorney should be consulted regarding the details.
