Alabama - Valid oral contract?

I have been in a relationship for 6 years. I was concerned that he was unfaithful and dishonest. We purchased a home together in AL. We each put $100K down & are both on deed & mortgagte. I wanted an agreement drawn up in case we didn not marry. we both hired attorneys to draft agreement. After the agreement was complete he refused to sign and said that he is a man of his word & that I must have faith in him & trust him. We broke up 60 days later. He continued to make all payments according to our agrrement for 4 months. He met another woman & stopped making pymts. Do I have a valid contract? Oral contract? What are my damages? Treble damages? Punitive? Thx

Well you certainly need an attorney and there is more information needed. Who lives in the house, you or him? There is no valid oral contract, but there is a valid legal contract as to ownership of the house. So the question is, what do you plan to do with the house now? Are you going to make the payments? If the house is for sale, who lives in house until it sells? Who makes payments on house until it sells? You are both in business together.
