Legal Question in Civil Litigation in Alabama

Depositions

Who may ''attend'' a civil deposition. Anyone the deponent desires? Is the deponent allowed technical help by someone else? Are spectators allowed? Who may participate? Even though there may be a court reporter taking the deposition, can the deponent videotape it? Voice record it? How can I get access to a deposition taken in another case if the deposition firm and the attorney refuses to release it? Is it unusual for the defense to hold a deposition at 9 PM at the Plaintiffs home?

You can tell I am not a lowyer. All Help will be appreciated. Thanks

The attorneys, and parties, and court reporter are present at depositions. No, you cannot have anyone there for moral support or for technical assistance unless the attorney taking the deposition would agree. You can record it yourself if you desire. The only way to get a deposition from another case is from the attorney or party to the case, unless it has been made a matter of the court record in the case. It is unusual to hold a depositon at 9pm at the plaintiffs home, but I do not know anything improper about it. Hope this helps.
