Toddler injured at daycare

My 2yr old son was injured when a T.V. fell on top of him while in daycare. The teacher was very negligent in caring for the children and was in the room and did nothing to stop the accident from happening. She was fired but I want to know if there is any way I can bring suit against her. This does not need to happen again.

Potentially. It would depend on the facts surrounding the incident. What caused the television to fall? Is it a licensed daycare? Is she licensed? How many children are in the daycare? How badly was your two year old injured? All of these issues need to be addressed before it can be determined if a lawsuit would be economically feasible. Yes you can sue the teacher and the business. A child under the age of 7 has an irrebutable presumption that he/she is not negligent. The real issue is the extent of the injuries to your child and was the daycare in a private home?, a business establishment, a franchise, etc.
