Does the mother have automatic full custody if she was never married to the father?

The statute that addresses custody of a child born to unmarried parents states that it depends on which parent the child has resided with for the greater part of the past six months. However, this "statutory" custody can be overcome by an agreement of the parties or a court order based on the "best interest of the child."
