Is having your only your eyes closed for a short period of time considered sleeping on the job, They were not snoring and their eyes were not closed but looking down at the floor and the supervisor assumed they were sleeping

It's a supervisor's judgment call. There may be bigger performance issues. The law does not monitor performance issues, just prohibited discrimination.
