Wrongful fines and term

My husband is currently a service manager in a pest control company- call this company X.Since before he started working at X, some chemicals have been stored outside the building.The state pest control commission (SPCC) regualrly inspects X and never cited X for this storage in the 1st 3 years my husband worked at X.His superiors at X did nothing about this storage. My husband had no way to know this was improper since X superiors left it there for years and SPCC monitors had never said anything.Last summer, the SPCC was contacted by a disgruntled employee that was being terminated by X and advised that the chemicals were improperly stored.One of the SPCC investigators had previously worked at X.Based on the tip SPCC came out,cited the branch for improper storage and will be imposing fines for it.X has told my husband that the fines-up to $10,000, will be against must be paid by him personally if he wants to keep his job with X and his pest control license with the state. Legal or illegal?

From the facts as presented, it does not appear that the company can lawfully hold your husband responsible. However, we would need to discuss this further before we can provide you with a legal opinion.
