Depending upon the value of the equity in the property, you may or may not be required to go to probate and you may or may not be able to simply file an affidavit with the court which would allow for transfer of the property ownership to you. It also depends upon whether you mother sold the property on a contract or if she took a promissory note for the purchase price and the title to the property is in the buyer's name. You should consult with an attorney and find out what is the case.
