partner in arizona sold our house. Built with our money sold the home gave owners Warranty Deed. Never paid Us nor did we sign a Deed of Release. Paid us monthly payments told us it was rented. We just found out a few months ago. Can we lien his home?

In order to "lien" his home, you must file a law suit and from the few facts that you provide, I would advise you to take action as soon as possible. First, I would advise you to make a criminal complaint with the police department where the property is located or with the County Attorney as this sounds to me like a clear case of embezzlement. You say "partner" but what was your agreement? did you form a partnership with a written agreement? did you ever transfer title to the property to him or to a partnership? is your partner a licensed real estate agent? a licensed contractor? You should consult with an attorney immediately and find out what alternatives are available to you.
