Legal Question in Family Law in Arkansas

Verbal Agreement on Visitation

Two years ago I got divorced and now my ex has primary custody of my daughter. The decree states that we were to come up with a reasonable visitation schedule for my daughter and I. In past two years I have had a few visits with my daughter because I was stationed overseas. Now I am back in the states and still having problems when it comes to my visits. I am married now and will be in SC for at least four years. I am ready to fight for custody of my daughter because her father will not keep his word about my visits. If I am ever stationed overseas again he may keep her away from me again. I don't want to start this if I dont have a chance to win because the last thing I need to do is make him mad for no reason. Do I have a chance of getting my daughter back?

Re: Verbal Agreement on Visitation

Without knowing much, much more about the facts of your case, it is impossible at this point to give an opinion as to your chances of getting custody.

However, if you are not happy with the current arrangement, you may want to file an action to have the visitation days/times specified even if you decide not to pursue custody.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
