Bussiness Issue from Portugal

hello,

i'm from Portugal, and i need some help. About one year ago, i had signed a agreement with a American company from California. In the agreement says that i had to pay an amount of money in the exchange of start fabricating a product, before i import it, to Portugal. I had payed the requested amount of money, but until now i don't have the product here and they are not giving me any kind of news. They are ignoring my calls and requests. And I'm loosing money because of that. What can I do, here from Portugal, to defend my rights. Please help me. I'm desperate.

Since you have a basis to sue the company in California courts, hire a local attorney to do so, or to negotiate a resolution/settlement if possible. If the company is in Southern California, feel free to contact me if serious about doing so. If your contract has a provision for attorney fees, you may be able to get them paid as well as your debt.

Hello,

The best approach is to retain an attorney in California that specializes in business disputes. The attorney can threaten the company with a lawsuit if they do not comply with the terms of the agreement.

In most cases it is better to negotiate extensively before filing a lawsuit since the costs of a lawsuit are significant and the timeline for having your case heard in court could be as long as 2-3 years.

It is common for foreign companies to retain an attorney in the U.S. even if they have never met the attorney in person. In our practice we have never met 10% of our clients in person since they are located in different countries and they have never traveled to the U.S.

Estou respondendo em portugues, pois � mais facil entender. Eu notei que dois colegas ja responderam � questao.

Seria o caso de mandar uma notifica�ao extrajudicial requerendo o imediato envio do produto, conforme o pagamento ja efetuado.

Isto poderia ser feito diretamente de Portugal ou entao, como os colegas, mencionaram de um advogado na California.

Se o problema � a lingua, eu tenho muitos contatos de advogados que falam portugues e assim posso passar o contato diretamente. Neste caso, se houver interesse, me manda um email diretamente.
