Legal Question in Bankruptcy in California

Is there a qualification we have to meet to file chapter 7. This wipes out all our debts isn\'t it. Can we keep our assets if we file chapter 7. Thank you

Under the new bankruptcy law there is a \'means test\' meaning you have to prove you are poor enough for a Chapter 7 -- otherwise you could be forced to file a Chapter 13. A Chapter 7 wipes out most debts with a few exceptions such as student loans and some taxes. You will keep a limited amount of assets. Could be a Chapter 13 would be better for you. Your question just cannot be answered in the abstract. It all depends. You will need to bring all your financial information to a bankruptcy attorney if you want a useful answer.
