Legal Question in Consumer Law in California

Bad wedding hair & makeup

I hired a hair and makeup ''artist'' to do my hair and makeup and my 3 bridesmaids hair & makeup on my wedding day. He promised that I would like his results and he was also very expensive, the most expensive hair/makup person I found so for sure that he would be a good choice.

I called him several times prior to the wedding day and asked him if he would do a ''test run'' with my hair and makeup for the big day. Several times he told me that it wasn't necessary and that I would like his work.

On the wedding day, he made my bridesmaids and I late for my wedding because he couldn't finish the job in the amount of time he requested (we were there for 5 hours for 4 girls) and he would not put my hair in an updo style for my wedding, even though I had asked him several times. He kept changing the subject saying ''I like your hair down, think about wearing it down'' and he would move onto another task.

In short, he put the colors of makeup on me and my bridesmaids that we told him not to, and he would not put my hair up the way I requested for my wedding day. I looked so bad I actually re-did my wedding photos and incurred even more expenses.

He refuses to give me a refund. Do I have a case in small claims court?

Re: Bad wedding hair & makeup

Yes, you have a claim for breach of contract and for negligence as well. You can bring this in small claims court. You will need to prove this with a) the written contract if any, 2) proof of payment, 3) photos of the poor makeup and hair, 4) proof of payment for the replacement photos (and any hair/makeup work done for the makeup photos). if you really want to nail it down, you could have a couple of your bridesmaids in court to testify as to the poor job he did and the excessive time he took. Good luck.
