Legal Question in Consumer Law in California

Private party purchase

We sold our 2001 car to some friends and kept the car in our name. Three months into the contract they decided that they don't want the car. They expect us to give them back $900 bucks of the $1900.00 that they paid to us. I explained to them that I don't feel any money is due and now they refuse to give the car back. It doesn't say anything in the contract about when the down payment was due or how much. Do I have the right to take the car back from them and not give them any money back? They have put 8000k miles on the car since the purchase. At this point they are current, but say that they are not going to give any money on the car and the car payment is due on the 1st of March.

Re: Private party purchase

you dont have to take the car back and you cant really take it back without canceling the deal and refunding their money. What you can and should do is make them keep the car and go to small claims court for the rest of the money.
