Court Orders

My son was granted a divorce in 2000. His ex wife was ordered by the court to pay

consumer credit card balances. Apparently she did not because my son was contacted

recently by a collector who stated that the court order did not remove him from

responsibility for the debt and they wanted him to either pay or be sued. Under these circumstances can he be held responsible for the credit card debt that his ex wife, per divorce court order, was supposed to pay?

The short answer is yes. Because California is a community property state, he can be held liable for pre-divorce debts. However, he can sue his ex-spouse to recover any amounts he is required to pay to the creditors.
