Legal Question in Credit and Debt Law in California

credit card collection

My spouse has a credit card debt that is 8 years old. Two years ago, we attempted to clear it from his report by trying to settle with the third party who purchased it. The total was $7500, but we reached a settlement (which we did NOT get in writing) of $5000 and paid $3000 of it. Of course after six months they reneged on the settlement and demanded more than we could afford. After getting hung up on repeatedly, we quit trying. Now another agency owns the debt and is demanding payment. They've tacked on more interest and the balance is now up to $6900. It seems like our payment of $3000 did nothing to bring down the debt. What can we do? We want to clear this from his credit report.

Re: credit card collection

Thank you for your posting.

Only by challenging incorrect information, or negotiating a settlement (in WRITING this time), can you force or get the original creditor to agree to reduce this debt.

I hope this information helps, but if you do have any other questions, want more information regarding any part of my answer, or feel that you need legal representation, please feel free to email me directly at [email protected]. Im happy to help in any way that I can, and best of luck.
