Legal Question in Credit and Debt Law in California

Regarding wedding cancellation

The contract stated that 45 days prior, 100% would be due. Isn't there sircumstances if a immediate family member is ill. I mean he was in ICU for weeks....We cancelled 30 days prior. It was July 29 and the wedding would of been Aug. 30. Don't know if they tired booking another event.

Re: Regarding wedding cancellation

First, your lawyer might be more effective than you in a letter making the argument that 30 days instead of 45 is not a material breach. More importantly, the wedding venue has a duty to mitigate damages, meaning, they have to try to find someone else to fill your spot. If they did not try to do this sufficiently, they are probably not justified in keeping your money. I would have an attorney write them a letter. Please contact my office if you want my help.
