Legal Question in Criminal Law in California

extortion

my ex-girlfriend has damaged my vehicles on multiple occasions and i grabbed her and pushed her away from one of the vehicles she was trying to slash the tires or something. It's been over a month since that happened. Now she's threatening to file a report if i don't return the vehicle to her that she was using to get around. Do I need to file a police report?

You should consult with an attorney and take pro-active action to protect yourself. Often in these cases the first party to take action prevails.

Re: extortion

You absolutely need to file a report of the attempted vandalism, the threats and extortion, IMMEDIATELY. In addition, if you can get any corroboration of the attempted extortion, it would help. Like if you let someone eavesdrop while you discussed this extortion attempt again.

Do NOT let her know you have done this. Avoid any further meetings with her, as it would create a new opportunity to set up a "domestic violence" fake accusation.

She is one of a growing number of people who see Domestic Violence laws as a personal power trip to make money, even scores and even punish people for breaking up with them. Watch your back. If thwarted in one attempt, she can just accelerate the campaign to "get" you.
