Legal Question in Criminal Law in California

my fiance is charged with murder

My fiance of 2 years is charged

with 2 counts of first degree

murder with special circ.(financial

gain)for his parents that were

killed by his now ex-friend This

happened 9 years ago My fiance

and the guy who killed his parents

were 19 at the time His EX friend

was convicted 9 years ago and is

now dead Now, they are accusing

my fiance of planning or

masterminding the murder for his

parent's money My fiance was

at his ex-friend's house. the night

it happened, his ex-friend invited

my fiance and a bunch of his

friends over for a party and took

off to my fiance's house to kill his

parents Please note that the guy

who killed his parents was proven

psyco in court. My fiance has for

years, mourned and mourned over

their death and didn't know how

crazy his friend at the time was. it

has been tremendously hard on

him and now very hard on me. we

were pregnant and didn't know it

when the police station called him

and told him to come to the station

to get some property that

belonged to his parents, but

instead arrested him. i miscarried.

he is innocent!!! do we have any

hope? he is a wonderful person.

the type who truley loves his

family.

Obviously he needs a good lawyer who will raise the argument that the 9 year delay deprived your fiance of a fair trial.

Only a lawyer thoroughly familiar with all the facts of the case can advise you or your boyfriend what chances of prevailing in court he will have. This is obviously the time to retain a very good lawyer. If you cannot afford one, a public defender will be assigned to your case.

Only hope lies with a sophisticated trial attorney who has done murder trials and is accustomed to investigating "stale" cases...also requires a great investigator.....Many legal issues present w/stale cases and can only be litigated (w/hope of success) by counsel who is experienced in this area...seems everyone agrees he needs a great attorney....best.
