Legal Question in Criminal Law in California

Medical Patient & HS11357b

This all happened in Simi Valley (Ventura County) in CA. I am a Medical Marijuana Patient with a valid physician's prescription. I was ticketed for possesion because the deputy could not verify me (my doc's office was closed) this is my first offense ever, I am 19 years old. First, will the DA drop the charges/dismiss after verifying me? My boyfriend was driving my car (registered to my mom) he was speeding, the deputy did not give either of us speeding tickets but can that come up against us again? will it affect my case? because I am under 21 will my driver's liscense get suspended or is all of that dismissed because I am a verifiable medical marijuana patient? What should I expect and/or prepare for the court? I heard these are simple low key cases but I am a patient for a reason and thats why I looked into a physician's prescription, so I could avoid all this mess...so my questions: is it more than likely the charges will be dropped? does my boyfriend's speeding matter? will my liscense get suspended?

It is very hard to give you any good answers because you didn't tell us many important things about your case. Ventura County DAs are sometimes brutal, and you can't just count of the matter being dismissed. If you have a lawyer and are willing to fight the DA and have a judge dismiss the case, it is very possible that it could be dismissed, but that depends on other stuff you don't mention. If the case is dismissed, then there will not be a license suspension. The question about your boyfriend's speeding is also hard to answer, because the total situation must be analyzed in order to know what is best for you. I recommend that you consult with a criminal lawyer experienced in medical marijuana cases. Most criminal lawyers give free consultations, but not all criminal lawyers are experienced with med MJ cases. I have handled many of them and would be happy to meet with you. If you'd like to do that, please contact me via email. Please put your name in the SUBJECT LINE. Best of luck. Steve Mandell
