Spousal Abuse 243 (e) (1)

How thoroughly does the district attorney's office investigate a defendants personal history/background in preparation for trial? What does he look for and whom does he contact, or is this only the responsbility of the probation department after trial? Thank you .

Yes, that is correct. They don't investigate except through the department of justice to see if there are prior charges or convictions, etc.

The full record and rap sheet is reviewed in every case by the DA and the court. Probation does a post- or pre- sentencing report if requested by the court, which looks at present situation. How thoroughly they research depends on what they and the DA and the Court want done. They play this game for keeps; if you've got a 'bad ass' history, its going to bite you.
