Legal Question in DUI Law in California

2nd DUI under 21

I got a ticket for a dui about two weeks ago. My situation is I just got done completing all the programs and fines and work release from a previous DUI about a year and half ago when I was 18 years of age . I want to know what the DA in RIverside County would more than likely charge me with. Will this be charge a fellony because I'm under 21, Do I have to serve any jail time at all. And also side information, I did take a chemical test, but my rights were never read to me, and I was not driving the vechicle because it was inoperable when the poilice came and did not have any collision with anybody and just had the violation of a DUI Misdemenor written on my tickect, and I was released from jail from the sobering cell a few hours after the situation and was not kept or sent to a correction facility.

Re: 2nd DUI under 21

The DA will most likely charge a second violation of DUI. If you are under 21, the penalties include revocation of your license. If you were not charged. If, because of the fact you posted, the DA decides not to charge you with a second DUI, consider yourself very lucky. Good Luck.
