Legal Question in DUI Law in California

Car Accident

I was involved in a car accident in state of CA.I was injured and rushed to the hospital so could not collect details about other driver but the cops did the paper work while I was moved from the scene . Few days later I personally went to police station to get copy of the report but I was told the other car driver was DUI and so I cannot get the report immediately , they said I might have to collect it from DA's office .

Is there such a law that prohibits obtaining copy of the accident report from cops if one of the drivers was DUI ?

This is a policy followed by all police departments that I am familiar with. You should however, be able to get information regarding the other drivers name, vehicle license number and other information that does not pertain to the dui. If the police will not give you that information contact the da and ask for help.
