Legal Question in DUI Law in California

D.U.I. arrest on private property?

An officer had stated that they may not make an arrest for D.U.I. until the subject has left private property. If I was parked at a company can an officer legaly arrest me?

Re: D.U.I. arrest on private property?

California law provides that a police officer can arrest an individual that is driving under the influence on private property. The appellate courts have upheld convictions based on a person being in a car and being under the influence of drugs or alcohol. You should discuss your particular facts with an attorney immediately.
