Thank you for your posting. A "DUI" can be a felony or a misdemeanor, depending upon the facts of the case. For example, a person driving under the influence that causes an accident where there is "serious bodily injury", can be charged with felony DUI. Also, someone that has three or more DUIs and gets a new DUI can be charged with DUI as a felony, even if there was no injury.
