Legal Question in DUI Law in California

incompetency

if I submit a document from my psychiatrist stating that ''I would reccomend that all proceedings be deferred at this time'' will the court then send me to a locked mental facility? or will they just ask for weekly or bimonthly reports from my psychiatrist? I'm currently on a medical o.r. because the jail failed to give me my transplant medication so I had to be hospitalized back in January.

Re: incompetency

Whether the court would place you in jail pending your recovery and trial, would depend upon several factors. What are the underlying charges. Do you have a criminal record. Since the judge released you in regard to the heart transplant treatment, there is a relatively high probability you will not be incarcerated. If these delays contintue the probability of being incarcerated increases very quickly.
