Legal Question in DUI Law in California

I was given a ticket for public intoxication at 7am on sat morning because I was sleeping in my car in a parking lot of a apartment (my car was parked incorrectly). I am 20 years of age, I had been drinking mildly the night before.

My question is am I guilty for public intoxication?

Most people believe the crime of public intoxication is merely being intoxicated in a public place. That is NOT the law. To be guilty of public intoxication, the prosecution has to show that , as a result of being intoxicated, the defendant was a danger to themselves or others. Many law enforcement officers don't get it either. You should not plead guilty until you speak to a real criminal law specialist. I wish you the best. David Wallin
